1. Acceptance of Terms

By accessing or using the Asheville AI website, requesting a Free Business AI Readiness Assessment, or engaging our implementation services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please discontinue use of the site.

2. Free Business AI Readiness Assessments & ROI Calculators

Our Free Business AI Readiness Assessment and online ROI Calculator provide preliminary operational estimates based on the workflow parameters you supply. While grounded in real-world implementation benchmarks across Western North Carolina small businesses, these estimates are informational and do not constitute a binding financial guarantee. Formal implementation deliverables, timelines, and service-level agreements (SLAs) are established in a written Statement of Work (SOW) signed by both parties.

3. Client Ownership & Intellectual Property

• Your Business Data & Custom Workflows: Upon full payment under an applicable Statement of Work, you retain full ownership of your business data, custom prompts, knowledge bases, and bespoke workflow configurations created specifically for your organization.
• Asheville AI Lab Frameworks: Asheville AI retains ownership of its pre-existing code libraries, reusable engineering templates, website content, and proprietary in-house lab products (including Voicemagic.dev, Asheville.gg, and published works such as ChatGPT on ChatGPT: The AI Explains Itself).

4. Responsible AI Operation & Human-in-the-Loop

Large language models and voice synthesis systems are probabilistic technologies. While Asheville AI engineers strict guardrails, validation rules, and sandbox testing into every deployment, clients are responsible for reviewing critical outputs (such as medical, legal, financial, or compliance-sensitive communications) and maintaining appropriate human-in-the-loop oversight for their industry.

5. Limitation of Liability

To the fullest extent permitted by law, Asheville AI shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of this website, third-party API outages (such as upstream LLM, telephony, or CRM provider downtime), or reliance on preliminary ROI estimates. For paid consulting engagements, our total liability is governed by the limits set forth in the applicable Statement of Work.

6. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Buncombe County, North Carolina.
